Terms of Service

These Terms of Service govern your access to and use of PathoDiff at pathodiff.com and related application pages.

Agreement

By accessing or using PathoDiff, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. The service is offered by PathoDiff.

The service

PathoDiff provides AI-assisted decision support for anatomical pathologists, including structured case entry, ranked differentials, must-not-miss style alerts, suggested next tests, and optional PDF or markdown export of results. Features, limits, and plan tiers may change as the product evolves.

Professional use only

PathoDiff is assistive decision support only. It does not replace professional pathologic judgment, correlation with clinical findings, or institutional protocols. Final diagnosis and management decisions remain solely with the responsible pathologist and clinical team.

PathoDiff is not a medical device for autonomous diagnosis, not patient-facing care, and not a substitute for your professional judgment, institutional protocols, or multidisciplinary review. You remain solely responsible for diagnosis, reporting, and clinical decisions.

Acceptable use

  • Use de-identified case content only. Do not enter PHI or direct patient identifiers.
  • Do not use PathoDiff for patient-facing autonomous reporting or as the sole basis for clinical action without professional review.
  • Do not attempt to bypass usage limits, abuse rate limits, reverse engineer the service, or interfere with its security or availability.
  • Do not use the service for unlawful purposes or in violation of your employer’s or institution’s policies.

Accounts and usage limits

Guests may try a limited number of analyses without an account. Free accounts add private saved cases and a higher rolling limit. Pro and Team plans raise or remove analysis caps as described on the pricing page. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

Paid plans and billing

Paid subscriptions are processed by Stripe. Prices, billing intervals, and taxes are shown at checkout or in the customer portal. Entitlements are applied when payment status is confirmed through our billing systems; temporary checkout return URLs alone do not grant paid access. Unless otherwise stated at purchase, subscriptions renew until cancelled. You may manage or cancel through the billing portal where available.

Intellectual property

PathoDiff, including its software, branding, and documentation, is owned by us or our licensors. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your professional purposes. You retain rights in case content you submit, and you grant us the rights needed to process that content to provide the service (including transmission to the configured model provider).

Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available,” and we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or other applicable law. Model outputs may be incomplete, incorrect, or outdated. Always verify against current literature, guidelines, and institutional protocols.

Limitation of liability

To the maximum extent permitted by law, PathoDiff and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business interruption, arising from your use of the service. Our aggregate liability for claims relating to the service will not exceed the amounts you paid to us for the service in the twelve months before the claim, or if you have not paid us, one hundred Australian dollars (AUD $100), except where a greater minimum liability cannot be limited by law.

Termination

You may stop using PathoDiff at any time. We may suspend or terminate access if you violate these terms, create risk to the service or other users, or if we discontinue the product. Provisions that by their nature should survive (including disclaimers, limitations of liability, and ownership) will survive termination.

Changes

We may update these terms as the product evolves. The “Last updated” date reflects the latest revision. Continued use after changes become effective constitutes acceptance of the updated terms.

Governing law and contact

These terms are governed by the laws of Australia, without regard to conflict-of-law rules, except where mandatory consumer or professional regulations apply. Courts in New South Wales, Australia have non-exclusive jurisdiction. Contact: privacy@pathodiff.com · https://pathodiff.com.
